General terms and conditions of sale

OBJECT

These General Terms and Conditions of Sale govern the rights and obligations of the parties in the context of online sales on the voltaswiss.ch website.

PURCHASE

General principle
Any purchase of an item on the voltaswiss.ch website constitutes acceptance of these General Terms and Conditions of Sale by the Buyer.
The General Terms and Conditions of Sale are available on the voltaswiss.ch website and when the Buyer confirms an order. The Buyer can consult them before clicking on the checkbox entitled I have read the general terms and conditions of sale and I accept them unreservedly.

Confirmation and conclusion of the contract
Any successful purchase will be the subject of a confirmation message to the Buyer and an order confirmation e-mail.
The sales contract is deemed to have been concluded at the time of order confirmation by the Seller, which takes place after validation of the order and receipt of the sale price. In all cases, the sale price is due on conclusion of the contract, i.e. on confirmation of the order by the seller. The latter may withhold delivery until it has received payment. Exceptionally, the seller may, without waiving these terms and conditions, authorise deferred payment.
By placing an order, the Buyer declares that he/she is in full possession of his/her civil rights.

Obligations of the Buyer
The Buyer undertakes to provide valid contact details when placing the order and to pay the price requested.
Domicile restrictions: The purchaser is obliged to comply with the laws in force in his/her country of domicile when placing an order for a product offered for sale on the voltaswiss.ch website. It is up to the customer to find out from customs whether the legislation authorises importation into the country of destination. For deliveries outside Switzerland and Liechtenstein, delivery costs are not included in the price and will be charged at the time of delivery.
The Seller accepts no responsibility for the fact that goods ordered cannot be delivered due to lack of available stock, additional supplies, production or customs seizure.
The Seller remains free to delete or modify the products offered, at its sole discretion and at any time.

PRICE

The prices in this catalogue are guaranteed net, excluding VAT, in Swiss francs.
The prices shown do not include shipping costs, which are charged as a flat rate or as an additional charge and vary according to the weight and size of the parcel.
Charges for deliveries within Switzerland are indicated in the order summary.
Once the order has been validated, the price cannot be changed.
Subject to the foregoing, the Seller is authorised to modify, at its sole discretion and at any time, the price of the goods offered.

TERMS OF PAYMENT

Shipment of products is subject to 100% payment on order or payable net on invoice, without deduction, within 30 days of the invoice date, as specified in the order confirmation.
As soon as the payment deadline specified in the order confirmation is exceeded, Volta Swiss Sàrl will charge default interest.

PRODUCT DISPATCH AND LEAD TIMES

Items in stock are dispatched/delivered within 1 to 5 working days, except in special cases.
Items are dispatched/delivered within 15 to 20 working days, except in special cases.
Delays in delivery do not entitle the customer to claim damages.
The carrier is responsible for the goods during their transit to the Buyer. The transfer of risk – which includes the risk of loss and deterioration of the goods – passes to the Buyer when the Buyer takes delivery of the goods.
We do not study the laws in force in countries other than Switzerland. The company cannot under any circumstances be held responsible if the parcel does not reach its destination.

DELIVERY AND NOTICE OF DEFECTS

The condition of the goods delivered must be checked within 2 working days of receipt to exclude obvious material and manufacturing defects, as well as transport damage. In accordance with the law, in the event of a defect or anomaly affecting the goods, the customer must notify Volta Swiss Sàrl within the same period. After this period, the delivery is deemed to be free of defects and to have been definitively accepted by Sàrl within the same period.
Volta Swiss Sàrl analyses the alleged defects, but only guarantees within the limits of the Swiss Code of Obligations. Goods with recognised and well-founded manufacturing defects, which have been the subject of a complaint within the time limit, will be replaced.
Goods found to have a recognised manufacturing defect, which have been the subject of a complaint in good time, will be replaced, with no right to rescission or reduction of the sale price.
Exchanged goods become the property of Volta Swiss Sàrl.
Any additional compensation will not be taken into consideration.

RETURNS AND REFUNDS

Apart from the aforementioned cases of defect, goods will only be taken back in certain exceptional cases.
To be eligible for return, it must be unused and in the same condition as when received. It must also be in the original packaging and accompanied by the delivery note, receipt or proof of purchase.
The goods must not be returned to the manufacturer.
Transport costs for the return of goods shall be borne by the Buyer.
Once the return has been received and inspected, Volta Swiss will send an e-mail to inform you whether or not the refund has been approved.
If approved, the refund will be processed and a credit will automatically be applied to the Buyer’s original payment method within a certain number of days. Only 75% of the net value of the goods will be credited.

GUARANTEE

The legal guarantee is 12 months unless otherwise stated on the product description at the time of purchase. The guarantee takes effect on the date of delivery of the item, as evidenced by the accompanying document (invoice), which the Buyer must keep carefully. The following are not covered: damage caused by poor maintenance, failure to follow the instructions for use or normal wear and tear.
If the product requires installation, continuity of the warranty requires installation by an authorised person and in accordance with the manufacturer’s description.of use or normal wear and tear.

RETENTION OF TITLE

The goods delivered remain the property of Volta Swiss Sàrl until full payment of the agreed price, including additional costs and interest. Until that date, they may not be pledged, sold or even rented out without authorisation. Volta Swiss Sàrl is entitled to have its reservation of ownership entered in the reservation of ownership register at the customer’s/reseller’s domicile.n pledged, sold or even hired out without authorisation. The latter also undertakes to notify us without delay of any change of domicile/registered office and of any claim by a third party to goods subject to retention of title.nt/retailer.nt pledged, sold or even hired out without authorisation.

MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

The Seller may amend these General Terms and Conditions of Sale from time to time. The contractual relationship between the Buyer and the Seller shall be governed by the version in force at the time the order is placed.

APPLICABLE LAW AND PLACE OF JURISDICTION

In the event of a dispute, the General Terms and Conditions of Sale in force at the time of purchase shall be used as the legal basis.
The applicable law is Swiss law and any dispute will be handled by the Tribunal d’arrondissement de l’Est-Vaudois in Vevey.
